Through passion and precision, not only a compelling concept emerged, but also an exceptionally intelligent app. When the time came for technological renewal, the entrepreneur turned to a prominent IT company. In good faith, technical blueprints, business plans, and crucial know-how were shared. After all, major innovation arises through collaboration.

However, where one party saw knowledge as a common foundation, the other mainly saw an opportunity. Negotiations broke down. Not long afterwards, the IT company suddenly launched an almost identical app. A harsh reality: the innovation which took years to develop was appropriated without consent and on the basis of confidential information. In such cases, there can be no compromise: this must be prohibited. And swiftly, before the damage becomes too great. Our remedy: injunctive relief proceeding!

From trust to legal action: where is the line?
Collaboration requires openness, but also clear boundaries. In any innovation trajectory, it is essential to lay down proper agreements in advance regarding confidentiality and use of know-how. Yet not everything can be watertight; sometimes trust is confronted by commercial opportunism. This was such a case. Where the parties had already exchanged a great deal prior to the confidentiality agreement, the court did not take this fact as a carte blanche. On the contrary – the court confirmed that even prior to the conclusion of a contract, improper use of provided knowledge may be unlawful.

The judge stated unequivocally: “It is indeed true that, in the preparatory phase of negotiations, knowledge may be shared, but this does not relieve a party of its obligation to act honestly and with integrity.” That nuance is crucial: confidentiality extends beyond the written document. Doing business means innovating together – but not engaging in unfair competition.

Decisive action, significant consequences
We acted immediately. We requested and obtained – in preliminary relief proceedings – a prohibition against further use and exploitation of the copied app. The IT provider had to immediately cease distribution, remove all versions, and faced a substantial penalty payment in case of violation of the judgment. Such rulings are unusually stringent and clear: those who rely on business agreements and honesty can expect the court to uphold them.

What makes this outcome unique is not only the legal victory (of which we are, professionally, rightly proud!), but above all, the significance for our client and the principled message: technical know-how, innovation models, and commercial plans deserve protection, even if formalities are not always fully completed.
