The process: steps and impact
- Response from the opposing party: The defendant must appear before the court by the roll date and will be given a period to respond in writing (statement of defense).
- No response? If the defendant does not reply, the judge will render a default judgment.
- Hearing: If the defendant does reply, a hearing will follow where both parties may present their positions.
- Judgment: The judge issues a decision. The prevailing party may have the judgment served by a bailiff and can take enforcement measures if necessary.
